INTERIM REPORT OF THE KENT COUNTY GRAND JURY

Reported October 6, 2009

Please note: An indictment, information, or complaint is merely an allegation. The U.S. Constitution guarantees that a defendant is presumed innocent unless and until proven guilty in a court of law.

Phillip Markoff, DOB: 2/12/86

8 High Point Circle, Apt. 301

Quincy, MA

K1-2009-0591A

The Kent County Grand Jury handed up a secret indictment yesterday, Oct. 6, naming Phillip Markoff on one count of assault with a dangerous weapon and one count of assault with the intent to commit robbery. It is alleged that on or about Apr. 16, 2009, Markoff assaulted a victim with a dangerous weapon, to wit, a pistol, and that he assaulted a second victim with the intent to commit robbery. The alleged incidents occurred in Warwick, at the Holiday Inn Express Hotel located at 901 Jefferson Boulevard.  Warwick Police conducted the investigation.
After screening the case, the Attorney General’s Office presented it to the grand jury, resulting in the secret indictment. “Secret” refers to the fact that neither an arrest nor a District Court complaint generated the indictment.
The Attorney General’s Office requested that the court issue a warrant for Markoff’s arrest, ensuring that once Markoff, the alleged “Craigslist Killer,” has been tried for the murder of Julissa Brisman and the armed robbery of Trisha Leffler in Massachusetts, he will be returned to Rhode Island to stand trial. This warrant, along with a detainer and the indictment, has been lodged with the Nashua Street jail in Boston, and replaces the affidavit and complaint arrest warrant originally filed by Warwick Police Chief Stephen M. McCartney and Attorney General Patrick C. Lynch on May 4 of this year.
Markoff, who is held without bail at the Nashua Street jail, pleaded not guilty to one count of first-degree murder and six other charges in Suffolk County Superior Court on June 22, 2009.
The two felony counts on which Markoff has been indicted in Rhode Island each carry 20-year maximum penalties.
